Privacy Policy

Welcome to the Privacy Policy ("Policy") of fAIshion Inc, including its related, affiliated or subsidiary companies doing business as ("fAIshion"). This Policy explains how we collect, use, and share your personal information when you use the fAIshion website, browser plug-in, API and/or mobile application ("App") and through all other technologies, products and services provided by fAIshion (collectively "Services").

By using the Services, you represent that you understand and agree to this Policy, and consent to the collection, use, and sharing of your personal information as described in this policy. If you do not consent to our practices, you can choose not to use the Services. The term "personal information", as used in this Privacy Policy, means any information associated with you that is protected under any applicable privacy or data protection law.

fAIshion is a provider of virtual try-on products, services and technology. This Policy covers both the public-facing web sites operated by fAIshion (the "Public Sites") as well as Services provided to its customers in any form and through any medium or platform.

Privacy Policy Changes. We may update this policy from time to time, and we will provide notice of any such changes to the policy as may be required by law. The date the privacy policy was last updated is identified at the top of the page. We will notify you of changes to this policy by updating the "last updated" date and posting the updated policy on the Services. We may email or otherwise communicate reminders about this policy, but you should check our Services periodically to see the current policy and any changes we have made to it.

INFORMATION WE COLLECT

Information You Provide

fAIshion collects information about you when you interact with our Services including information that you voluntarily provide when you create an account, log into the Services from one or more of your devices, use our App/plug-in, sign up for our newsletter and/or updates, complete a web form, add or update your account information, or otherwise interact with the Services. Information that we collect may depend on how you use the Services. A description of the types of information we may collect is described in detail below:

  • Profile Data, such as email, password, and user settings.
  • Personal Identifiers such as name, address, telephone number, date of birth, gender, social security number or tax identification number, and driver's license or state-issued identification card.
  • Body Data created using image, likeness or other personal information about you in the form of photographs taken and processed through our App, or by utilizing offline body dimension scanner devices, or as manually inputted by users.
  • Usage Data, such as information about how you use our website, browser plug-in and App, including likes, shares, referring/exit pages, and clickstream data.
  • Marketing and Communications Information, such as marketing campaign data, click through, your preferences and consent in receiving marketing from us and third parties, your communication preferences, email, phone calls, text communications, and in-app and push notifications.
  • Audio, electronic, and visual information, such as profile pictures, uploaded images, videos, and call recordings (where permitted by law) that you provide or generate through the Services.
  • Geolocation Data such as your physical location.
  • Financial Information including credit card information, financial institution name, account name, account type, account ownership, branch number, IBAN, BIC, account and routing number, transaction data, account history, and account balances.

User-Generated Content and Community Features

We may provide features that allow you to post, share, or communicate with others, including through comments and community interactions. Content you submit through these features may be visible to other users or publicly, depending on how your preferences are configured.

You are responsible for the content you choose to share and for ensuring that you have the necessary rights and permissions to share such content, including any personal information about other individuals.

We reserve the right to remove or delete content that violates applicable law, our policies, or the rights of others. You may request deletion of your content in accordance with applicable law, and we will review and respond to such requests as required.

Information We Collect When You Use the Services

Automated technologies or interactions. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, time zone setting and location, language preferences, device type and ID, date/time stamp, location data, and other technical information from the devices you use to access our Services. Also, when performing Services, fAIshion may receive body data without any other personally identifying information. In these cases, fAIshion has no ability to identify the individual associated with the body data. fAIshion may use pixel tags, web beacons, and other similar technologies to record information about how individuals access our Services. This information is typically not personally identifiable and may include IP addresses (or the DNS name associated with it) of the individual's computer, the web site from which the individual linked to our Services, and the browser software the individual is using to access our Services. This information is used in the aggregate to administer computer systems and to make improvements to our Services.

Cookies and Tracking Technologies. We and our service providers use cookies, pixels, and other tracking technology to recognize your browser or device and to capture and remember certain information about your activities on our Services.

Cookies. A cookie is a small text file that is saved on your web browser when you visit a website. You can view and delete existing cookies through your browser. If you do not want to store cookies on your computer, you can set your browser to refuse cookies or to alert you when cookies are being sent. However, some parts of the Services may not function properly if you choose not to accept cookies.

Pixel Tags (aka clear gifs). These are tiny graphics with a unique identifier, similar in function to cookies, which allow us to monitor the use of our Services, for example, to count users who have visited those pages and for other related website statistics. Pixel tags generally work in conjunction with cookies, registering when a particular computer visits a particular page. You cannot decline pixel tags; however, if you turn off cookies the pixel tag will simply detect an anonymous visit. In addition, we use pixel tags in our HTML-based emails to let us know which emails have been opened by the recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.

Analytics. We use third-party cookies provided by Google Analytics to assist us in better understanding our website visitors. These cookies collect IP address and usage data, such as the length of time a user spends on a page, the pages a user visits, and the websites a user visits before and after visiting our website. In addition to reporting usage statistics, Google Analytics can also be used to help show more relevant ads on Google properties (like Google Search) and across the web. Information You Provide To A Third Party

We may receive information about you from third parties. We may associate this information with the other information we have collected about you. The collection, use, and disclosure of information received from third parties are governed by the third parties' privacy policies. Please carefully review these third-party privacy policies to understand how your information may be collected, used, and disclosed by these third parties.

fAIshion has relationships with various businesses and other entities, which may require fAIshion to collect and process personal information on their behalf or with whom fAIshion may share your personal information. This might happen, for example, if such businesses and other entities integrate fAIshion's technology into their own website or mobile app. In these cases, fAIshion will comply with the privacy-related instructions given to fAIshion by these businesses and other entities, and you should review the privacy policy of such businesses or entities to determine how they use your information. In this situation, we consider such business or entity to be the "controller" of the personal information, and fAIshion to be the "processor" unless fAIshion and such business or entity otherwise agrees.

USE OF YOUR INFORMATION

Our primary purpose for collecting your personal information is to provide you with the Services you request. We may also use your information for the following purposes:

  • Provide you with our products and services and operate our business.
  • Verify your identity and account information in connection with the products or services you request.
  • Provide you with required notices, updates about your purchase(s) and other important information.
  • Provide you with recommendations for products and services that we believe would be of interest to you.
  • Provide you with our newsletter if you have subscribed to it.
  • Assist you with setting up and managing your account with us.
  • Resolve disputes.
  • Problem troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting data.
  • Enforce our Terms of Use for use of our services and the terms of this Policy.
  • Customize, measure and improve our services and content.
  • Communicate with you about products, services, updates, events, promotional offers, research, insights, and other information that may be of interest to you from us and our trusted partners.
  • Protect our interests, including establishing, exercising and defending legal and intellectual property rights and claims.
  • As necessary to comply with legal requirements, to prevent fraud, to co-operate with law enforcement and regulatory authorities, and to stop other prohibited, illegal, or harmful activities.

Legal Basis for Processing (EEA/UK Users)

If you are located in the European Economic Area or the United Kingdom, we process your personal information under the following legal bases:

  • Performance of a contract such as providing the Services you request
  • Your consent such as marketing communications or processing of certain sensitive data
  • Our legitimate interests such as improving our Services, preventing fraud, and ensuring security
  • Compliance with legal obligations

INFORMATION WE SHARE

Information You Instruct Us to Share. You may be presented with an option to have us send certain information to third parties or give them access to it. If you choose to do so, your information will be disclosed to such third parties and all information you disclose will be subject to the third-party privacy policies and practices of such third parties.

Service Providers. We may use third-party service providers to perform certain business services and may disclose your information to such service providers as needed for them to perform these business services. Service providers are only allowed to use, disclose, or retain this information to provide these services. Business services provided include, but are not limited to, hosting services, software as a service (SaaS), document management services, communications services such as email, text and chat services, software and website development services, analytics services, credit risk and analytics services, credit score services, call center services, and marketing services.

Third Party Marketers and Lenders. Non-sensitive information may be shared with third-party lenders, advertisers, and marketers that we are under contract with. These third parties may use this information to offer products that you have expressed interest in or other products, services, events, promotional offers, research, insights, and other information that may be of interest to you. You can opt out from receiving such offers and messages by unsubscribing from these third parties' marketing lists.

Internal Third Parties. We may share your information with our parent company, subsidiaries, successors, predecessors, assigns, licensees, affiliates, or business partners, and others who may use the information for the purposes described above.

Business Transactions. We may do business with third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your information in the same way as set out in this Policy.

Legal Process. Subject to applicable law, we may disclose information about you i) if we are required to do so by law, regulation, orders, or legal process, such as a subpoena; ii) in response to requests by government entities, such as law enforcement authorities; iii) when we believe disclosure is necessary or appropriate to prevent physical, financial, or other harm, injury, or loss; or iv) in connection with an investigation of suspected or actual unlawful activity.

DEVICE ACCESS

Our App may access functions on your mobile device to offer you services and products from fAIshion including:

  • Hardware communications (to provide account notifications);
  • Local storage (to provide loan documents that you download through the app);
  • Camera (to capture images);
  • Speaker (as may be required by law); and
  • GPS (to confirm that you are based in the State of California where fAIshion is legally authorized to conduct its business).

We will request your permission to access your device's GPS location data when you first download the App. You may be able to control the App's access to your location by turning off your mobile device's GPS technology using the settings available on your specific device.

COMMUNICATIONS AND OPT-OUT

While we value our communications with you, if you do not want fAIshion or its representatives to contact you for marketing purposes, you may opt-out of this preference at any time by following the unsubscribe instructions included in the email. This opt-out will not apply to operational or informational emails related to your account or other administrative purposes. You may continue to receive promotional email messages for a short period while we process your request.

ADDITIONAL RIGHTS FOR EEA/UK USERS

If you are located in the European Economic Area or the United Kingdom, you have the following rights under applicable data protection laws:

  • The right to access your personal information
  • The right to request correction of inaccurate data
  • The right to request deletion of your personal information
  • The right to restrict or object to processing
  • The right to data portability
  • The right to withdraw consent at any time

You also have the right to lodge a complaint with your local data protection authority.

CHILDREN AND MINOR'S DATA

Our Services are not intended for individuals under the age of 18, and we do not knowingly allow individuals under 18 to use the Services or create accounts. If we become aware that we have collected personal data from an individual under 18, we will delete such information as soon as reasonably possible.

INTERNATIONAL DATA TRANSFERS

Your personal information may be transferred to, stored, and processed in countries other than the country in which you reside, including the United States, where data protection laws may differ from those in your jurisdiction.

Where required by applicable law, including for users located in the European Economic Area or the United Kingdom, we implement appropriate safeguards to protect your personal information when it is transferred internationally. These safeguards may include the use of standard contractual clauses approved by the European Commission or other lawful transfer mechanisms.

By using our Services, you understand that your personal information may be transferred to our facilities and to third parties with whom we share it as described in this Policy.

SECURITY

Any data collected will be protected using reasonable physical, electronic, and procedural safeguards. Please be aware that even the most reasonable security measures may not be able to prevent all potential security breaches. No transmission of data over the Internet is guaranteed to be completely secure and we cannot guarantee that your submissions to the Services, any content residing on our servers, or any transmissions from our server will be completely secure. It may be possible for third parties to intercept or access transmissions or private communications unlawfully. Any such transmission is done at your own risk.

HOW WE RETAIN YOUR PERSONAL DATA

We keep the categories of personal data described in this policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain personal data. At the end of the retention period, personal data will be deleted, destroyed, or de-identified.

NOTICE TO CALIFORNIA RESIDENTS

If you are a California resident, you have certain rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CPRA).

Subject to certain limitations, you have the right to:

  • Request to know the categories and specific pieces of personal information we have collected about you

  • Request correction of inaccurate personal information

We collect personal information from the categories of sources described in this Privacy Policy, and for the business and commercial purposes described above.

We may disclose personal information to the categories of third parties described in this Privacy Policy, including service providers, business partners, and analytics providers.

You may also designate an authorized agent to submit a request on your behalf, subject to verification requirements.

Do Not Track. Our Services do not accept or process Do Not Track signals or similar mechanisms. Other Third-Party Websites may keep track of your browsing activities when they provide you with content, which enables them to customize what they present to you on their websites.
